When to use it
Use when a client receives a character-related notice under s 501 or a s 501CA notice of mandatory cancellation. Confirm which Ministerial Direction applies at the date of decision: Direction no. 123 for decisions on or after 31 October 2026, Direction no. 110 before. Do not use for s 116 general cancellation notices without adapting it.
How AI may be used
Lawyer or agent led. AI may table the notice, criminal history and sentencing material against the considerations in the applicable Direction, with the source document and date beside each fact, and list considerations with no evidence. It must not write the representations or the client's or witnesses' statements.
AI may
- Extract from the service material the date the notice was given and the date particulars were given, for a person to check
- Table each fact from the notice, criminal history and sentencing remarks against the Direction's considerations, citing the document and page
- List considerations for which the file has no evidence yet
AI must not
- Must not draft the representations, the client's statement or any support letter
- Must not characterise the seriousness of offending, risk of reoffending or the strength of ties
- Must not be relied on for which Direction applies, or for the deadline
The lawyer checks
- Which Direction applies at the expected decision date, and whether the decision-maker is a delegate, the Tribunal or the Minister personally
- The deadline (28 days after notice and particulars for s 501CA under reg 2.52) is calculated and diarised by a person
- Every fact is supported by evidence, and non-refoulement claims are raised and evidenced where relevant
- Statements from the client and supporters are in their own words
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
