When to use it

Use when preparing a student visa application lodged on or after 23 March 2024. Applications lodged before that date are assessed under the Genuine Temporary Entrant requirement, which this checklist does not restate.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may list which evidence is missing against the Genuine Student page; the practitioner settles every word that will be typed into the application, and AI does not write those answers.

AI may

  • List the five form questions and tick the evidence the page asks for against documents the applicant has supplied
  • Flag a study gap of more than two months, a change of course, or a previous visa refusal, as a topic the page says is considered
  • Count words in a draft the applicant has written, against the 150-word limit

AI must not

  • Must not write the answers that will be lodged, or a separate Genuine Student statement the page says it would rather not receive
  • Must not treat a later plan to seek permanent residence as a point against the applicant; the page says that intention does not count against them
  • Must not set out Ministerial Direction No. 106; the page refers to it and the direction was not opened

The lawyer checks

  • The application date is on or after 23 March 2024, so the Genuine Student requirement applies
  • Each lodged answer is in English, within 150 words, and is supported by a document where the page says evidence is given more weight
  • Home-country ties, course choice, and immigration history are each addressed from the applicant's own documents
  • Nothing in the lodged answers was generated and then presented as the applicant's own account

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
