Where this comes from
The official form is published by art.gov.au; this page is a completion guide. Last checked on 2026-10-17.
When to use it
Use as soon as a client receives a reviewable visa refusal or cancellation decision from the Department. Time limits are strict and the Tribunal cannot extend most migration review deadlines. Do not use for character decisions under s 501 without checking the separate process and 9-day expedited deadline.
How AI may be used
Lawyer or agent led. Deadlines are calculated from the notification and diarised by a person, never by an AI tool. AI may help extract dates and facts from the decision record into a triage sheet that a person checks against the source documents.
AI may
- Extract decision date, method of notification and stated review deadline from the decision letter into a triage sheet for checking
- Build a visa and notification chronology with the document that proves each date
- Draft a checklist of documents to send with the application
AI must not
- Must not calculate or diarise the review deadline as the only control
- Must not decide whether the decision is reviewable or who may apply
- Must not write grounds, statements of facts or any part of the client's evidence
The lawyer checks
- Reviewability, the correct applicant and the time limit are confirmed from the decision letter and the law
- The application is lodged (online where possible) well before the deadline, and receipt is saved
- Fee or fee reduction is dealt with as the Tribunal requires
- Any AI use in documents given to the Tribunal complies with the Generative AI Practice Direction
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
