The work product
Forum. A New South Wales CTP insurer or workers compensation insurer
Produce. A letter the lawyer settles before it is sent.
Have ready. The current liability decision and the documents it relies on; Outstanding medical or wage requests; The claim type and the injury date.
Example of the limit. Illustrative example: The insurer has denied weekly payments. The draft letter asks for the documents relied on and lists the certificate still to be sent. It does not say the client accepts the denial.
Stop and hand it back when
- The draft concedes liability, quantum, or a time-limit point.
- The letter is being used as the claim itself and no approved form has been lodged.

Checklist
- Section 6.15 requires notice of a CTP claim in the form approved by the Authority. SIRA says that notice is the claim form, not a free-form letter.
- Section 6.13: a statutory benefits claim is made within 3 months. If it is not made within 28 days, weekly payments are not payable for any period before the claim, unless the regulations permit it.
- Section 261 of the 1998 Act: compensation cannot be recovered unless the claim is made within 6 months, subject to the ignorance, mistake, absence or other reasonable-cause excuses in that section.
- Motor Accident Guidelines clause 4.16: a claim on the Nominal Defendant must be made within 28 days of the accident to receive weekly payments from the day after the accident.
