When to use it
Use when preparing the attendance and proxy record for a Victorian owners corporation general meeting, and when deciding whether a decision made without a quorum can be acted on.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may list lot owners, proxies and fee balances from the records. It must not decide that a quorum was present or that a vote counted.
AI may
- List lot owners, proxies and powers of attorney named in forms in the file
- Add the fee balance shown on the levy ledger next to each lot
- Count the proxy expiry as 12 months after the date the form was delivered, unless the form states an earlier date
AI must not
- Must not decide that a quorum was present
- Must not decide that a lot owner in arrears was entitled to vote
- Must not draft a proxy form or say that a person was coerced
The lawyer checks
- Quorum is at least 50 per cent of the total votes or lot entitlements, counting the people the page names
- A lot owner who owes money is not treated as entitled to vote on an ordinary resolution
- An interim decision is not acted on before the 29 days, or after a petition or special-meeting notice of the kind the page describes
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
