When to use it
Use when checking insurance for a Queensland body corporate under the Body Corporate and Community Management Act. Building-format detail and the 1980 Act are on pages that were not used for those tests.
Used for these tasks
- Prepare the scheme's insurance and valuation compliance report
- Identify the governing statute and the by-law or scheme-rule power before advising
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may enter the policy limits from the schedule and flag a public risk figure below $10 million, and the lawyer checks each policy, the module and the replacement value.
AI may
- Enter the insurer, period, replacement sum and public risk limit from the policy schedule
- Flag a public risk limit below $10 million for a single event, or below $10 million for the period of the policy
- List body corporate assets named in the asset register that have no public risk note in the file
AI must not
- Must not decide that it is practical to insure a particular asset for public risk
- Must not decide that a building contains a lot or that the scheme is registered under another Act
- Must not choose the insurer or the sum insured
The lawyer checks
- The scheme is one to which this page applies, not the Building Units and Group Titles Act 1980 page
- Public risk is at least $10 million for a single event and at least $10 million across the period of the policy
- Common property and body corporate assets are insured for full replacement value, including the extra costs the page lists
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
