When to use it
Use when a Queensland body corporate believes an owner or occupier is breaching a by-law (continuing) or has breached one and is likely to repeat it (future). The BCCM Form 10 or Form 11 can be used instead of the letter; the content is the same.
How AI may be used
AI may draft the notice letter and the committee decision from the complaint file and the registered by-laws; the committee or its lawyer checks the type of notice, the by-law, the facts and the time to comply before it is given.
AI may
- Draft the description of the breach and the time to remedy from complaints, photos and correspondence
- Identify whether a continuing or future contravention notice fits the facts, for the committee to decide
- Prepare the copy-to-owner letter and diarise follow-up dates
AI must not
- Must not name an owner or property manager when the person in breach is an occupier
- Must not describe conduct, dates or approvals that are not in the evidence
- Must not choose between Magistrates Court proceedings and conciliation for the body corporate
The lawyer checks
- The by-law is recorded for the scheme and validly applies to the conduct
- The committee or a general meeting decided to give the notice, and the right notice type (continuing or future) is used for the scheme type
- The time given to remedy a continuing contravention is reasonable for the work required
- A copy has gone to the owner as soon as possible where an occupier was given the notice
