When to use it
Use when strata levies in an NSW scheme are more than one month overdue and the owners corporation is considering recovery in the Tribunal or a court. Use the checklist before any statement of claim or Tribunal application is filed.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may reconcile the levy ledger and draft the reminder and notice from it; a lawyer or the strata manager checks every amount, the interest and that each precondition to recovery is met before the notice is sent.
AI may
- Reconcile the levy register against each levy notice, due date and payment
- Calculate interest at the statutory rate on each overdue contribution, showing the working
- Draft the reminder and the s 86 notice from the reconciled figures
AI must not
- Must not decide that recovery may start, or state an earliest filing date, without the checklist being completed by the lawyer
- Must not include legal costs in the amount demanded as if already owing: reasonable recovery expenses are recoverable only by order
- Must not threaten action against an owner who has a payment plan being complied with, or a request for a plan that has not been decided
The lawyer checks
- Each levy was validly raised and the levy notice gave the minimum notice to pay
- Interest is calculated at 10% simple only on contributions unpaid more than one month after the due date, and no resolution waived it
- The notice sets out the amount, the recovery action proposed, the due date, how to pay and whether a payment plan may be entered into
- At least 30 days have passed since the notice was given before any action, and no complying payment plan is in place
