Use when a Victorian lot owner has not paid owners corporation fees within 28 days of a fee notice and the owners corporation intends to recover them. The notices must be in the approved forms published by Consumer Affairs Victoria.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may reconcile the fee ledger, calculate daily penalty interest and fill the approved form fields from the records; the owners corporation manager or lawyer checks every amount, the interest resolution and the dates before the notice is given.
AI may
- Reconcile fees, charges and payments for the lot against each fee notice
- Calculate the daily penalty interest figure from the current rate, showing the working
- Draft the covering letter and fill the fields of the approved forms from the reconciled ledger
AI must not
- Must not change the wording or layout of the approved forms or substitute a home-made notice
- Must not include penalty interest unless the owners corporation has resolved to charge it
- Must not state that VCAT action has started or will start on a date earlier than 28 days after the final fee notice is given
The lawyer checks
- A fee notice in the approved form was given and 28 days have passed before the final fee notice is given
- Penalty interest is charged only under a resolution and at no more than the rate under the Penalty Interest Rates Act 1983 (Vic), and the daily figure is correct
- The lot owner name and address match the owners corporation register
- Any payment plan request or hardship information has been considered before recovery action
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
