How AI may be used
AI may turn minutes and correspondence into a chronology and draft the orders sought, within NCAT Procedural Direction 7. It must not generate the content of any statement or affidavit.
AI may
- Build a chronology and document index from minutes, by-laws, notices and correspondence (permitted by PD7 para 11).
- Draft the orders sought and a summary of the dispute for the lawyer to settle.
- Draft written submissions, with every citation then verified by a person (PD7 paras 16–17).
AI must not
- Must not generate or rephrase the content of statements, affidavits or statutory declarations (PD7 paras 12–14).
- Must not receive material subject to a confidentiality order or produced under summons unless PD7 para 9 conditions are met.
- Must not be used to verify citations on its own (PD7 para 17).
The lawyer checks
- Mediation certificate attached or an exemption under s 227(4) applies.
- The correct respondent is named, with correct legal name and address for service.
- Each order sought is within the Tribunal's power and the evidence supports it.
- Any Gen AI use complies with PD7 and is disclosed where required.
