When to use it
Use when a respondent has been served with a Victorian payment claim and does not agree to pay the claimed amount by the due date. If the respondent agrees, the Commission page says to pay the amount in full on or before the due date.
Used for these tasks
- Draft the payment schedule and adjudication response
- Check AI-drafted payment claims and schedules against the security-of-payment Act
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may calculate the tenth business day from the service date once the lawyer has set what a business day is under the Act. It must not write the reasons for withholding.
AI may
- Enter the date the payment claim was served and list a candidate tenth business day for the lawyer to confirm
- Check that a draft schedule identifies the claim and states a scheduled amount
- Flag a draft that gives no reason where the scheduled amount is less than the claimed amount
AI must not
- Must not write the reasons for withholding or for a lower amount
- Must not decide the due date for payment
- Must not say that a missed schedule can be cured except by recording the section 18(2) step the Commission describes
The lawyer checks
- Business day is counted as the Act counts it. This page does not define the term
- The contract is checked for a shorter period than 10 business days
- Each reason is one the respondent can support from the contract and the facts
