When to use it
Use when listing the statutory warranties to check against a Victorian domestic building defect. It does not decide whether the work breached a warranty or whether a claim is in time.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may place each defect against a warranty heading from the inspection report. It must not decide that a warranty was breached or that the 10-year period has expired.
AI may
- List defects from an inspection report under the warranty headings on the page
- Enter the completion date supplied in the file and count 10 years as a candidate end date
- Flag a contract clause that says the warranties are excluded
AI must not
- Must not decide that work was or was not done in a proper and workmanlike manner
- Must not decide that the Building Act period has ended
- Must not draft the defects claim or a statement of the owner
The lawyer checks
- The 2025 amending Act is checked for commencement before the list is relied on
- The completion date is taken from a document, not from a recollection in the instruction
- The page's 10-year statement is checked against the current Building Act section
