When to use it
Use before a claimant serves a Victorian payment claim. It does not replace the payment schedule, and it is not used for a domestic building contract with a building owner who is outside the Act.
Used for these tasks
- Prepare and check a progress-payment claim before it is served
- Check AI-drafted payment claims and schedules against the security-of-payment Act
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may check that the endorsement and the service method are present. It must not describe the work, set the amount, or decide that the Act applies.
AI may
- Check the draft for the endorsement sentence required by the Commission page
- List the service method named in the contract, if the contract states one
- Enter the month the work was first carried out, from the site records
AI must not
- Must not write the description of the construction work or related goods and services
- Must not calculate or state the claimed amount
- Must not decide that the Act applies to a contract with a building owner
The lawyer checks
- The contract is one the Commission page says the Act applies to
- The service date is on or after the earliest day the page allows, and before the latest day
- The claimed amount takes into account the contract price, other rates or prices, and the estimated cost of rectifying any defect
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
