When to use it
Use when a licensed contractor has received, or expects, a direction to rectify from the Queensland Building and Construction Commission. The response to the direction is written separately.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may enter the direction's date, the licensee named, and the period printed on the direction. It writes none of the response.
AI may
- Enter the direction number, date, licensee and the period printed on the direction
- List photographs, contracts and variation records by date and description
- Flag a direction whose stated period ends within the next 7 days
AI must not
- Must not draft the response to the direction
- Must not admit or deny that work is defective
- Must not describe the cause of a defect or draft a witness statement
The lawyer checks
- The period is the period stated in the direction, not an assumed 35 days
- The dollar penalties on the Commission page are checked against the current penalty before they are quoted
- Any internal review is taken from the review pages, which were not used here
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
