When to use it
Use at the end of a quarter in which a mineral was produced or obtained under a Western Australian mining tenement. It does not calculate the royalty that will be paid.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may diary 30 days from the end of the quarter and class the mineral as specific-rate, ad valorem or gold from the fact sheet; the lawyer decides the royalty value and any allowable deduction.
AI may
- Enter the quarter end and the three 30-day dates
- Record tonnes, form of sale, and whether the mineral is on the private-land exclusion list
- Note that monthly gold prices and quarterly exchange rates are looked up on the fact sheet for that quarter
AI must not
- Must not calculate the royalty as the amount to be paid
- Must not apply a State Agreement rate that is not on this fact sheet
- Must not lodge the return or send the payment
The lawyer checks
- The mineral is not one the fact sheet excludes when it occurs on private land, or the exclusion does not apply
- The rate class matches how the mineral is sold in Western Australia, or the gold rule, or a State Agreement that has been read
- Allowable deductions are limited to reasonable transport costs in the form first sold, including packaging, as the fact sheet states
- The production report, the royalty return and the payment are all within 30 days after the end of the quarter, and the payment uses the payer reference
