When to use it
Use before a person or business applies to sell energy to customers, or asks whether an authorisation is required. It does not complete the application or the declarations.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may assemble the documents the page names and mark which of the three criteria each document goes to; the lawyer decides whether to apply or to seek an exemption.
AI may
- List policies, financial information and suitability material already on the file under the three criteria
- Record whether the Retailer Authorisation Guideline and the additional-information document have been read
- Note the email address the page gives for lodging the application with the checklist
AI must not
- Must not complete the declaration templates
- Must not decide that an exemption applies
- Must not send the application
The lawyer checks
- The activity is a retail sale of energy that requires an authorisation, or an exemption path under the Retail Exempt Selling Guideline has been read
- The application addresses organisational and technical capacity, financial resources, and suitability
- The checklist confirming that the application contains the information in the Guideline is included, because the page says feedback is given only then
- The public register is searched so an existing authorisation is not overlooked
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
