When to use it
Use when advising a resources or energy group on whether it must register and report, at each reporting year end, and when a facility may exceed its baseline. Check the current Act, rules and Clean Energy Regulator guidance before relying on it.
Used for these tasks
- Advise a corporate group on its greenhouse and energy reporting obligations
- Plan a safeguard facility's response to emissions above its baseline
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may tabulate facility emissions and energy data against the thresholds and baselines; the lawyer decides operational control, group membership, registration and the response to any excess.
AI may
- Tabulate each facility's emissions and energy production and consumption for the year against the s 13 thresholds
- Map group structure and facilities to the entity that appears to have operational control, for the lawyer to confirm
- Compare Safeguard facilities' net emissions with their baselines and flag a possible excess
AI must not
- Must not decide which entity has operational control or which corporation is the controlling corporation
- Must not calculate emissions using methods that are not those required by the measurement rules
- Must not advise on the response to an excess emissions situation
The lawyer checks
- Controlling corporation and group membership, and operational control of each facility under ss 11 and 11A
- Whether any threshold in s 13 is met, and the registration application date (31 August after the trigger year)
- For Safeguard facilities, the baseline, net emissions and the options to avoid or manage an excess before the monitoring period ends
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
