How AI is used
In a firm-controlled tool, compare the injury date, mechanism, body parts and time off work on a Victorian workers' or transport claim with the chronology and wage records, and list inconsistencies for the lawyer.
What the lawyer must review
  • Confirm each difference against the source record before the form is lodged.
  • Do not complete an authority or any verification part of the form.
  • Keep the records in a firm-controlled tool. ASCR r 9 and APP 11 apply.

The work product

Forum. Victoria: a WorkSafe workers' injury claim and a Transport Accident Commission Part 3 claim

Produce. A comparison of dates, mechanism, body parts and time off work, each tied to a source, for the lawyer to check before lodgement.

Have ready. Draft claim form; Clinical chronology; Wage records; Certificates of capacity.

Example of the limit. Illustrative example: The form says a fall on one date and the discharge summary says a lifting incident the next day. The tool lists both dates and the pages. The lawyer decides which date the form should carry.

Stop and hand it back when

  • The authority or a verification part of the form would have to be completed.
  • The records are available only in a public tool.

  4. Do not complete an authority to release medical information, or any verification part of the form.

WorkSafe's page says the worker reports the injury to the manager in writing as soon as possible and within 30 days. That report is separate from section 20. Section 20(8) requires a weekly-payments claim as soon as practicable after the incapacity becomes known, certain death claims within 2 years of the death, and a Division 7 of Part 5 claim within 6 months of the relevant service. Subsection (9) allows a waiver for a special excuse. Section 20(3) requires a signed authority on a claim other than a death claim. Do not complete that authority.

Transport Accident Act 1986 section 68 times a Part 3 compensation claim: within one year after the accident or death, or after the injury first manifests if none did at the time. The Commission may accept a later claim before three years after the accident, the death, or the injury first manifesting, if there are reasonable grounds for the delay. If the injured person, or a dependent child of a person who dies, was under 18 at the accident and no claim has been made, that person may claim before age 21 or within 3 years after the accident, whichever is the later. That extension is despite subsection (1) and is subject to subsection (2).
