The work product

Forum. Victoria: a Transport Accident Commission file, a WorkSafe file, or a common law file that uses those records

Produce. An internal chronology with page cites, certificate dates and a gap list.

Have ready. Treatment records the firm is allowed to use; Certificates of capacity and scheme letters; The firm's closed-tool settings.

Example of the limit. Illustrative example: A certificate covers four weeks and the only consultation page is the first day. The chronology shows the certificate period and marks the other weeks as having no consultation page. It does not say the person was symptom-free.

Stop and hand it back when

  • A row has no page cite.
  • The chronology states a diagnosis or says a benefit is payable.

Checklist

  1. Give each row the consultation date or the certificate date, the provider, and the page. Do not use the date of a later report as the date of treatment.
  2. On a Transport Accident Commission loss-of-earnings file, the Commission's policy says loss of earnings benefits are payable for a maximum of 18 months from the accident or from when the injury first manifested, where supported by certificates of capacity, and that loss of earning capacity benefits may then be available. Record the certificate dates. Do not decide the benefit.
  3. On a WorkSafe file, a certificate of capacity is required where the worker claims weekly payments or cannot do pre-injury work. Record the certificate period separately from the consultation.
  4. List gaps, including a certificate period with no consultation page. A gap is not proof that treatment or symptoms were absent. Do not send the records to a public tool.

This chronology is the content of the scheme file. The firm's rule for which tool a paralegal may use is a separate protocol.

The Health Records Act 2001 is in force as version 050, effective 1 May 2026. Its principles were not opened. If the chronology is later filed, the lawyer verifies it under Practice Note SC GEN 25 or the County Court practice note of 9 June 2026.
