Responsible Person suitability record under ACNC Governance Standard 4
Record of the searches and the declaration the ACNC describes for Governance Standard 4, before a person is appointed or while they remain a Responsible Person. It does not decide that a person is suitable in any wider sense.

When to use it
Use when a charity is appointing a board or committee member or a trustee, or reviewing people already appointed. The charity must not appoint a person it is not satisfied is free of the disqualifications the standard names.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may list Responsible People and the date of each search. The lawyer decides whether the charity is satisfied, and what to do if a person is disqualified.
AI may
- Enter each Responsible Person and any former name recorded on the file
- Record the date of an ASIC search and an ACNC search the lawyer has obtained
- Flag a person with no signed declaration
AI must not
- Must not state that a person is a fit and proper person beyond the two disqualifications the page names
- Must not treat a clear search as the whole of the standard if the charity suspects disqualification
- Must not draft the removal resolution
The lawyer checks
- Both registers have been searched, including any former name
- The declaration covers not being disqualified and understanding what disqualification means
- A person on a register, or who refuses to sign, is not left appointed without the removal steps in the governing document
- The page on how a person becomes disqualified was not opened and is read before advice on a borderline case
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
