When to use it
Use when a creditor will file a proof of claim in a bankruptcy case on the current Official Form 410, stating the claim as of the date the case was filed. Do not use it to draft the debtor's schedules.
Used for these tasks
- Review proofs of debt and draft the dividend schedule
- Assemble a creditor proof-of-debt evidence pack
- Build a creditor schedule from books and proofs of debt
- Summarise creditor claims into a schedule
- Prepare a proof of debt in the debtor’s liquidation
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool may list whether the petition date, the claim amount and the documents are still missing from a lawyer's index, and it must not draft the proof or the declaration.
AI may
- Remind the lawyer that every figure is stated as of the petition date on the notice of bankruptcy, Form 309
- Remind the lawyer that the form warns of a fine up to $500,000, imprisonment up to 5 years, or both, under 18 U.S.C. §§ 152, 157 and 3571
AI must not
- Must not state the amount of the claim, the payments already credited, or the security
- Must not draft the perjury declaration or an authorised signature
- Must not describe attachments. Attachment A and the supplements were not opened
- Must not say that a claim is valid or entitled to priority
The lawyer checks
- The form page says B 410 was updated on 1 April 2025, is effective 1 December 2024, and is derived from Official Form 10. It is an Official Bankruptcy Form and must be used under Bankruptcy Rule 9009
- The page says the form may be altered as described on the Permitted Changes page. That page was not opened, so no permitted alteration is listed
- The PDF says to fill in all information about the claim as of the date the case was filed, and that the date is on the notice of bankruptcy, Form 309
- A person who files a fraudulent claim could be fined up to $500,000, imprisoned for up to 5 years, or both. 18 U.S.C. §§ 152, 157 and 3571
- The signature block says the creditor has a reasonable belief the information is true and correct, and "I declare under penalty of perjury that the foregoing is true and correct." An authorised signature acknowledges credit for payments received
