When to use it
Use before filing any document in winding-up, statutory demand set-aside, voidable transaction, examination or bankruptcy proceedings where an AI tool was used at any stage. Do not use in place of reading the current practice note of the court in which you file.
How AI may be used
Close supervision. AI may help cross-check documents and citations, but verification of authorities cannot rest on AI alone, evidence must be the witness's own, and the responsible lawyer signs off every item.
AI may
- Check that each case and section cited exists on an official register or court website and list any that cannot be found.
- Cross-check names, ACNs, dates and amounts across the demand, affidavits, originating process and ASIC extract and list inconsistencies.
- Check that every evidence reference in submissions points to an existing affidavit paragraph or exhibit page.
AI must not
- Must not draft, alter or rephrase any affidavit or any part of a witness's evidence.
- Must not be the only means of verifying citations in submissions.
- Must not receive subpoenaed material, examination transcripts or material under suppression orders unless the court's conditions are met.
The lawyer checks
- Every authority has been read in its original source and supports the proposition for which it is cited.
- Required AI disclosures and verifications appear in the body of the document in the form the court requires.
- The responsible lawyer has signed off the completed checklist on the file.
