Official Form 309 notice of a bankruptcy case (Forms 309A to 309I)
Link to Official Form 309, the notice of the bankruptcy case sent to creditors and other parties. The clerk usually completes it. The version depends on the chapter, the debtor and whether a proof-of-claim deadline is set.

Where this comes from
The official form is published by uscourts.gov; this page is a completion guide. Last checked on 2026-10-22.
When to use it
Use to identify the notice creditors should receive after a petition is filed, and to prepare the notice when the court has delegated noticing. The national instructions opened for this guide are dated 1 December 2024.
Used for these tasks
- Prepare personal-insolvency papers: bankruptcy notice, petition or equivalent
- Draft procedural correspondence to the court with AI
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool may compare a draft notice with the petition and the creditor matrix and list mismatches; the lawyer selects the 309 version and does not let the tool rewrite the official text.
AI may
- Compare the debtor's name, chapter, and case number on a draft notice with Official Form 101
- List creditors on the matrix who are missing from a lawyer-prepared mailing list, and names on the list who are not on the matrix
- Identify which 309 letter the instructions say fits the chapter, the type of debtor, and whether a proof-of-claim deadline is set
AI must not
- Must not choose a proof-of-claim deadline or invent a meeting date
- Must not rewrite the official wording of the notice
- Must not add legal advice to creditors beyond what the instructions allow the court or the noticing party to add
- Must not send the notice
The lawyer checks
- The version matches the instructions: chapter, individual or joint debtor versus corporation or partnership, and whether a proof-of-claim deadline is included
- The meeting of creditors, deadlines and claim instructions on the notice match the court's order or the clerk's direction, not a guessed date
- The mailing list matches the debtor's matrix
- Any added text is only what the 1 December 2024 instructions allow: additional information, and updates to changed, broken or incorrect internet links
- Rule 9009 still applies. The instructions quote it and say the official forms must be used without alteration unless the national instructions authorise the change
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
