Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
Official Form 106Dec is signed under penalty of perjury for the summary and schedules, so the tool does not draft schedule entries or the declaration.
AI may
- Build a working index of assets, debts, leases and codebtors from the file, with document dates, that stays off the official forms
- Compare a lawyer-prepared schedule with that index and list items on one and not the other
- List which of the 106 forms the draft includes and which the forms list still shows as part of the individual set
AI must not
- Must not write values, creditor names, exemption claims or the declaration
- Must not classify a claim as secured, priority or unsecured
- Must not decide what property is exempt
- Must not hide property, round a balance, or omit a codebtor to make the schedules shorter
The lawyer checks
- Form 106Dec is filed with every set of schedules or amended schedules, and both spouses sign in a joint case
- The declaration the debtor signs states that the debtor has read the summary and schedules and that they are true and correct
- If someone who is not a lawyer was paid or will be paid to help, Official Form 119 is attached, as 106Dec asks
- The same person is Debtor 1 as on Official Form 101
- The forms are the current official forms, altered only as Rule 9009 allows
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
