When to use it

Use when a creditor lodges a formal proof of debt or claim in a company liquidation, especially for disputed, large or multi-component claims. It sits alongside the prescribed form; it does not replace it.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may assemble and index the evidence pack and reconcile the claimed amount to the invoices, ledger and contract, but the creditor or its lawyer settles the amount claimed and signs the proof, and the creditor’s own statements in it are not written by AI.

AI may

  • Index invoices, statements, contracts, guarantees and security documents and link each to a line in the claim schedule
  • Reconcile the claimed principal to the ledger and calculate interest at the contractual rate up to the date the lawyer specifies, showing each step
  • Draft the covering letter and the diary of the 7-day and appeal time limits

AI must not

  • Must not complete or sign the proof of debt or any statement in it for the creditor
  • Must not include amounts that are not supported by a document in the pack, or apply set-offs, credits or security values without the lawyer’s decision
  • Must not upload the company’s or creditor’s financial records to a tool that retains or trains on them

The lawyer checks

  • The correct form is used and the amount, the date the debt arose and the basis of the claim are right for the date of the winding up
  • Interest and costs are claimed only to the extent the contract and the law allow, and any security, guarantee, retention of title or set-off is disclosed and dealt with
  • The evidence pack supports each component of the claim, and the person signing the proof can stand behind it
  • The 7-day notice period and the appeal deadline are diarised as soon as any rejection is received
