Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
Form 122A-1 is declared under penalty of perjury, including the statement that spouses are separated, so the tool does not enter income figures or complete the means test.
AI may
- Extract pay, benefit and household-expense records from the file into a working table that is not the official form, with the document date for each figure
- List the six full calendar months before the filing date the lawyer has chosen, without averaging them
- Flag, from the forms list, which of 122A-1, 122A-1Supp, 122A-2, 122B, 122C-1 and 122C-2 the chapter of the petition would point to
AI must not
- Must not average income, apply IRS standards, or type any figure on the form
- Must not decide that the presumption of abuse does or does not arise
- Must not check the separation box or describe special circumstances
- Must not complete Form 122A-2, 122C-1 or 122C-2
The lawyer checks
- The chapter of the case matches the form: 122A for chapter 7, 122B for chapter 11, 122C for chapter 13, using the current form from the forms list
- Current monthly income is the six-month average the form describes, derived as 11 U.S.C. § 101(10A) requires, for the six full months before filing
- The separation box is checked only if it is true. Checking it is itself a declaration under penalty of perjury, and the form cites 11 U.S.C. § 707(b)(7)(B)
- Form 122A-2 is filed only if 122A-1 says to file it. The form says not to file 122A-2 if line 14a is checked
- The debtor signs under penalty of perjury that the statement and any attachments are true and correct. Special-circumstances facts under § 707(b)(2)(B) are itemised, documented, explained, and attested under oath
