Where this comes from

The official form is published by afsa.gov.au; this page is a completion guide. Last checked on 2026-10-17.

When to use it

Use when a creditor client holds a final judgment or order of $10,000 or more against an individual and wants to start bankruptcy proceedings. Do not use against a company (use a statutory demand) or before the judgment is final.

How AI may be used

Close supervision. The notice issues through AFSA's own system from a judgment, so AI may only prepare the judgment-debt particulars and an interest schedule for a person to check against the sealed judgment.

AI may

  • Extract the parties' names, judgment date, proceeding number and judgment amounts from the sealed judgment into a particulars sheet for checking.
  • Prepare a draft interest schedule using the rate and legislation the lawyer has identified, showing every step of the calculation.
  • Build a service checklist and evidence index for the affidavit of service.

AI must not

  • Must not insert a compliance or petition deadline as a date the firm relies on.
  • Must not submit or amend the application in AFSA Online Services.
  • Must not change the debtor's name from the form in the judgment, even to correct an apparent error.

The lawyer checks

  • Names match the judgment exactly and the judgment is final, unstayed and not more than 6 years old.
  • The amount claimed, excluding post-judgment interest, is at least the statutory minimum.
  • Any interest claimed is allowed by the court and the schedule is correct.
  • Service is effected within 6 months of issue and proved by affidavit.

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
