When to use it
Use when a Victorian retail premises lease has no option to renew and the term is between 12 and 6 months from ending, or the landlord missed that window and must give the later notice. Do not use it to exercise an option.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may insert the term dates from the lease and leave the offer or the refusal for the principal. The principal chooses the rent and whether to offer a renewal.
AI may
- Calculate the calendar window of 12 months to 6 months before the term ends and show the arithmetic
- Insert the premises and the parties
AI must not
- Must not choose whether a renewal is offered
- Must not set the rent or the new term
- Must not say that missing the window ends the lease
The lawyer checks
- The lease contains no option. If it does, section 64 does not apply and the option clause is used instead
- A notice that offers a renewal states the terms, including a term setting out the rent, and is not revoked inside 60 days without the tenant's consent
- A late notice under section 64(4) names a day at least 6 months after the notice is given
