Letter on allocation of public-accommodation duties
A letter asking the other party to a commercial lease to state how responsibility under 28 CFR part 36 is allocated. It does not decide that the premises are a place of public accommodation.

When to use it
Use when a lease is being negotiated or enforced and neither draft says who will do the work required by 28 CFR part 36. Send it only if counsel has decided the premises may be a place of public accommodation.
Used for these tasks
- Review a received lease and produce a tenant or landlord advice table
- Draft a plain-English lease summary for a tenant client
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may list the physical items the lawyer names and address the letter. The lawyer decides whether section 36.201 applies and what allocation to propose.
AI may
- List only the items the lawyer has seen or has been told are in issue
- Quote subsection (b) rather than paraphrase it into a waiver
- Flag a sentence that says one party has no duty to the public
AI must not
- Must not decide that the premises are a place of public accommodation
- Must not say that a private allocation ends either party's duty under the regulation
- Must not send the letter
The lawyer checks
- Counsel has read the definition of place of public accommodation before the letter goes
- The proposed allocation is as between the parties
- The letter matches the lease clause, or it says the lease is silent
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
