When to use it

Use when a tenant of Victorian retail premises asks the landlord to consent to an assignment. Do not use it for a commercial lease that the principal has decided is outside the Retail Leases Act 2003.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may assemble the request from names and documents the principal supplies. The principal decides that section 61 has been complied with before anyone counts 28 days.

AI may

  • Insert the parties, the premises and the proposed assignee's name from the file
  • List the attachments the principal has marked as enclosed

AI must not

  • Must not say that consent is deemed
  • Must not tell the landlord which section 60 ground applies
  • Must not invent the proposed assignee's financial position or business experience

The lawyer checks

  • The request is in writing and gives the information the landlord has reasonably required about financial resources and business experience
  • Section 61(3) was done before the request, or the section 61(5) excuse applies because a current disclosure statement was asked for and not given within 14 days
  • The 28 days in section 61(6) are counted from a request made after the tenant had complied with the section
