When to use it
Use for every brief, pleading, motion or other paper filed in a California court from 1 January 2027. Keep it in the matter file. It is not filed. It supports the disclosure statement and answers any later question about how citations were checked.
How to use this precedent
Check that it fits the matter: read “When to use it” and the places it applies to.
Log in to read the full text. It is free.
Adapt it to the matter, filling in each placeholder shown in [square brackets].
Use AI only as far as the Yellow level allows. “How AI may be used” says what AI may and must not do.
Before it goes out, a lawyer checks it against current law and each point under “The lawyer checks”.
How AI may be used
A tool may extract every citation from the draft into the table. Only the responsible attorney opens each source and marks it verified.
AI may
Extract each citation and the proposition it is cited for into the table
Flag citations that appear only once, have no pin cite or quote text
Compare a quotation in the draft with text the attorney has pasted from the source
AI must not
Must not mark any citation as verified, or fill in the 'verified by' or date columns
Must not say a case exists or what it holds unless the attorney has opened it
Must not suggest a replacement authority without flagging it as new and unverified
The lawyer checks
Each source was opened by the responsible attorney in an official reporter or a reliable database
Each quotation matches the source word for word and the pin cite is right
The final filed version matches the version checked; any later edit was rechecked
