When to use it
Use in every factum served or filed under the Ontario Rules of Civil Procedure from 1 September 2026, whether or not AI was used. A party acting in person signs it personally (r 4.06.1(2.1.1)). For expert reports, see the parallel quotation statement in r 53.03(2.1) para 6.3.
How to use this precedent
Check that it fits the matter: read “When to use it” and the places it applies to.
Log in to read the full text. It is free.
Adapt it to the matter, filling in each placeholder shown in [square brackets].
Use AI only as far as the Green level allows. “How AI may be used” says what AI may and must not do.
Before it goes out, a lawyer checks it against current law and each point under “The lawyer checks”.
How AI may be used
A tool may list the authorities and quotations for checking. Only the lawyer, or a person the lawyer specifically authorises, can sign the statement after the checks.
AI may
List every authority and quotation in the factum for checking
Lay out the signed statement
AI must not
Must not sign or mark the statement as signed
Must not treat a tool's own citation check as checking the text of the authority
The lawyer checks
Every authority was located and confirmed authentic
Every quotation was compared word for word with the authority
The signer is the party's lawyer or someone the lawyer specifically authorised (or the party acting in person)
