When to use it

Use when building a delegated-legislation checklist for a Commonwealth instrument. The principal confirms that it is a legislative instrument. The checklist does not decide that it has been repealed.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may enter the registration date the principal supplies and show the section 50 anniversary arithmetic, without stating that the instrument is repealed or unenforceable.

AI may

  • Record the instrument name and the registration date from the register extract the principal supplies
  • If registration was not on 1 January 2005, show the first 1 April or 1 October on or after the tenth anniversary
  • If registration was on 1 January 2005, copy the matching row of the section 50(2) table

AI must not

  • Must not decide that the instrument is a legislative instrument
  • Must not decide that section 50 has repealed it, or that Part 3 or sections 51, 51A, 53 or 54 do not apply
  • Must not describe those other provisions

The lawyer checks

  • The principal confirms the instrument is a legislative instrument, using the definition that was not opened here
  • The Federal Register extract is the source of the registration date
  • Part 3 and sections 51, 51A, 53 and 54 are opened before anyone relies on the repeal day
  • Section 15G was not opened, so the explanatory-statement duty is not described beyond section 15K(2)
