Where this comes from
The official form is published by art.gov.au; this page is a completion guide. Last checked on 2026-10-17.
When to use it
Use when a client wants merits review of a Commonwealth decision that an Act makes reviewable by the Administrative Review Tribunal. Always use the current official form or lodgement method. Do not use for decisions reviewable only by a court, or before any required internal review.
How AI may be used
AI may help prepare the chronology and a first draft of the reasons for seeking review from the decision and the client's instructions. The lawyer confirms jurisdiction, time and form, verifies every fact and citation, and makes any disclosure the Practice Direction requires.
AI may
- Draft the chronology and a short statement of why the decision is wrong from the decision, reasons and the client's documents, with references.
- Check a draft against the Practice Direction's verification list (facts provable, authorities exist, evidence references accurate).
- Produce a plain-language explanation of the process for the client.
AI must not
- Must not draft or alter the words of a statutory declaration or witness statement; the evidence must be the person's own.
- Must not enter documents the decision-maker lodges with the Tribunal, or confidential or privileged material, into a public AI tool.
- Must not decide reviewability, the correct form or the time limit.
The lawyer checks
- The decision is reviewable by the Tribunal and any internal review step has been completed.
- The time limit under the enabling Act or ART Rules s 5, and whether an extension application (s 19) is needed.
- Every citation and fact in any submission is verified, and any required Generative AI disclosure appears at or near the start of the document.
- The fee or concession evidence is attached and the current fee checked on the Tribunal website.
