When to use it

Use when preparing a grounds outline from a Commonwealth decision and the record. It places a fact next to a ground the principal names. It is not an application.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may place a fact from the record next to a section 5 ground the principal names, and must not plead a ground or say that it is made out.

AI may

  • Copy the grounds in section 5(1) and the improper-exercise matters in section 5(2)
  • Place a page or paragraph the principal identifies beside the ground the principal names

AI must not

  • Must not add a ground that is not in section 5
  • Must not say a ground is made out, or that the decision is reviewable
  • Must not treat the no-evidence ground as made out unless section 5(3) is addressed by the principal
  • Must not draft an originating application

The lawyer checks

  • The decision is one to which the Act applies, under the definition that was not opened here
  • The applicant is a person who is aggrieved, as the principal decides
  • The decision was made after the commencement of the Act
  • Any application is settled by the principal, in the form the court rules require

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
