When to use it
Use when a participant's file has one or more NDIA decisions and the dates for an internal review or a Tribunal application need to be diarised. Do not use a budget reduction as an internal-review row. The guide gives budget reductions as an example of a decision that is not reviewable.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may enter the decision date, the date received and the document titles, and diary the periods printed on the NDIA guide and the Tribunal page from the date received. A lawyer confirms the decision is reviewable before any review is requested.
AI may
- Enter the decision date, the date received and the document title from the file
- Diary 3 months from the date the decision was received, and 28 days from the date the internal review decision was received
- Flag a row that has a decision date but no date received, and flag a budget-reduction row
AI must not
- Must not mark a decision as reviewable
- Must not lodge an internal review or a Tribunal application
- Must not treat a budget reduction as a decision that can be internally reviewed
- Must not calculate a deadline from the decision date when the date received is missing
The lawyer checks
- The date received is the date on the file, and the 3-month and 28-day periods run from receipt
- A budget reduction is not given an internal-review row. High support needs, if relied on, is checked on the current NDIA page
- The 2026 Practice Direction is still the current common-procedures direction
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
