When to use it
Use when a person directly affected by an NDIA decision (for example, a refusal of access, a plan approval or a refusal to vary or reassess a plan) wants it changed. Check first that the decision is reviewable and that it is within 3 months of receiving the notice.
Used for these tasks
- Prepare the internal review request for an access or plan decision
- Map the treating evidence against the access or support criteria
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may draft the request from the decision notice, the reasons and the client's evidence, and map the evidence to the criteria; the lawyer checks reviewability, the deadline, every statement about the client and the evidence before it is sent.
AI may
- Extract the decision, the date it was received and the NDIA's reasons from the notice
- Map each report and letter to the access criteria or the reasonable and necessary criteria the decision turned on
- Draft the request and the evidence table from the verified material
AI must not
- Must not describe the client's disability, functional impact or daily life beyond what the evidence and the client say
- Must not decide that a decision is reviewable or that the request is in time
- Must not send the request or upload health records to an unapproved tool
The lawyer checks
- The decision is a reviewable decision and the request is made within 3 months after the notice was received
- The request names the decision, the outcome sought and the reasons, and addresses each point in the statement of reasons
- The client (or their nominee, child representative or authorised person) has approved the request and given consent for any representative to act
- The NDIA review decision date and the 28-day period to provide any requested information are diarised
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
