When to use it

Use when a Tribunal application is being prepared after an NDIA internal review, or after 90 days with no internal review decision. Prepare Part B only if the Tribunal has ordered a statement or the lawyer has decided to lodge one. Do not use it for a migration or protection decision.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may lay out the headings and copy document titles and dates into the index. The lawyer writes every fact, issue, contention and reason that is lodged. Nothing in this document is filed until the lawyer approves it.

AI may

  • Lay out the Part A details and the three Part B headings as blank fields
  • Copy document titles and dates from the file into the index, leaving the fact column blank
  • Flag a missing date received, a missing internal review request, or a statement that has not been ordered

AI must not

  • Must not write a fact, issue, contention or reason in the words that will be lodged
  • Must not file this document
  • Must not invent a section of the National Disability Insurance Scheme Act 2013, or a list of decision types under section 105
  • Must not put a person's health information, or a child's details, into an unapproved tool
  • Must not prepare Part B as if the Tribunal had ordered it, unless an order is on the file

The lawyer checks

  • Whether the 2026 Practice Direction is still current, and whether the Tribunal has ordered a statement
  • Every sentence that will be lodged, including the reasons and the decision asked for under section 105
  • Internal review is complete, or 90 days or another specified period have passed since the request
  • The 28 days run from the date the NDIA decision was received, and any extension is in writing with reasons

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
