Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may draft the letter from the decision, the reasons and the issues list, and index the records to enclose; the lawyer frames the questions neutrally and checks the brief, and the practitioner's report is the practitioner's own work.

AI may

  • Draft the questions from the criteria the decision turned on and the issues list
  • Index the records, previous reports and the NDIA decision to enclose
  • Prepare the cover email and a tracking entry

AI must not

  • Must not draft, suggest or edit any part of the practitioner's report or opinion
  • Must not frame questions that suggest the answer or leave out unhelpful records
  • Must not send health information to a tool not approved for it

The lawyer checks

  • The client has consented to the practitioner being asked and to the release of the records enclosed
  • The questions track the criteria the decision turned on and are neutral
  • For a Tribunal review, the expert has been given the Tribunal's current requirements for expert evidence and told the duty is to the Tribunal
  • All relevant records, helpful or not, are enclosed
