Where this comes from
The official form is published by uspto.gov; this page is a completion guide. Last checked on 2026-10-22.
When to use it
Use when an owner files a new U.S. trademark application. As of 18 January 2025 the USPTO page says Trademark Center is where that application is filed. Check the current TEAS retirement note before using an older form.
Used for these tasks
- Draft a trade mark specification of goods and services and check it against the IP Australia trade marks page
- Draft a trade mark goods and services specification
- Build a trade mark clearance conflict table
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool may check a lawyer-prepared goods list against the ID Manual headings the lawyer supplies, and it must not write the verified statement or any allegation of use, ownership or intent.
AI may
- Compare a lawyer-prepared identification with the requirement that identifications be selected from the ID Manual in Trademark Center
- List which base-application items on the USPTO table are still blank in a checklist the lawyer has started
- Flag a domicile outside the United States or its territories so the lawyer can add attorney name, postal address, email and bar information
AI must not
- Must not write or edit the verified statement, including ownership, use in commerce, intent to use, the specimen allegation, or the 'no other person' allegation
- Must not choose the filing basis under 37 CFR 2.34, 2.44 or 2.45
- Must not describe the mark, claim colour, translate wording, or say whether a name identifies a living individual
- Must not sign the application or state that the facts are true
The lawyer checks
- The application includes the owner's name, domicile address and email, the legal entity, and citizenship or the place of incorporation or organisation
- There is at least one filing basis that satisfies 37 CFR 2.34, 2.44 or 2.45, a fee for each class, and identifications selected from the ID Manual
- The verified statement meets 37 CFR 2.33, 2.44 or 2.45, and is dated and signed by a person properly authorised to sign for the owner
- Section 1(a) allegations and section 1(b) or 44 allegations are different. A statement not filed within a reasonable time after signing may have to be replaced
- A domicile outside the United States or its territories requires the attorney's name, postal address, email and bar information
- Trademark Center is the system the USPTO named, as of 18 January 2025, for a new application. The apply page says specified TEAS forms retire in late October, without stating the year on that bullet. Madrid filings based on a U.S. application or registration go through WIPO Madrid e-Filing from 1 October 2026
