When to use it
Use before a rights holder lodges a Notice of Objection so the Australian Border Force can seize infringing imports.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool lists registration numbers and expiry dates from an IP Australia extract the lawyer supplies, and the lawyer completes the official notice and the deed.
AI may
- Copy the trade mark number and expiry date from an extract the lawyer supplies into the row.
- Remind the lawyer which term the Border Force page states for the kind of right selected.
AI must not
- Do not complete or sign the Notice of Objection or the Deed of Undertaking.
- Do not say that particular goods infringe.
- Do not choose the kind of notice.
The lawyer checks
- Use the current form linked from the Border Force page. This checklist does not reproduce a form.
- A trade mark notice must reference a current registration. The page says a registered trade mark is valid for ten years once registered.
- A separate notice is required for each kind of right.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
Official form
Open the official form. Always use the current version from the issuer.
