Where this comes from
The official form is published by uspto.gov; this page is a completion guide. Last checked on 2026-10-22.
When to use it
Use when an inventor signs the declaration for a utility or design application that is filed with an application data sheet. Each additional inventor uses another AIA/01. A substitute statement, AIA/02, is a different form.
Used for these tasks
- Draft a patent specification from the inventor disclosure
- Check named inventors on an AI-assisted patent application
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The declaration warns that a willful false statement is punishable under 18 U.S.C. 1001, so the tool writes no inventorship statement and no signature.
AI may
- List the inventors named on a lawyer-prepared ADS and note which of them do not yet have a signed AIA/01 in the file
- Check that the file contains an ADS naming the inventive entity, which the form says must accompany AIA/01 or already have been filed
- Flag a draft that includes a Social Security number, bank account number or credit card number
AI must not
- Must not write or complete the statement that the declarant believes they are the original inventor or an original joint inventor
- Must not say the application was made or authorised by the declarant
- Must not sign the declaration or apply an S-signature
- Must not prepare a substitute statement on AIA/02
The lawyer checks
- The declaration is directed to the attached application, or to a U.S. or PCT application number and filing date, as the form provides
- The declarant states that the application was made or authorised to be made by the declarant, and that the declarant believes they are the original inventor or an original joint inventor of a claimed invention
- The form says a willful false statement is punishable under 18 U.S.C. 1001 by fine or imprisonment of not more than five years, or both
- Each additional inventor uses an additional AIA/01. An ADS naming the entire inventive entity, PTO/AIA/14 or an equivalent, must accompany the form or have been previously filed
- The form warns not to include a Social Security number, a bank account number or a credit card number, other than on form PTO-2038 for payment. The application record can become public. Read the form's warning on publication, nonpublication and abandonment before filing personal data
- AIA/02 is the substitute statement under 35 U.S.C. 115(d) and 37 CFR 1.64. It is listed on the forms index. It was not opened. Do not use AIA/01 where a substitute statement is the right form
