Where this comes from

The official form is published by sat.justice.wa.gov.au; this page is a completion guide. Last checked on 2026-10-22.

When to use it

Use when asking the State Administrative Tribunal of Western Australia to appoint a guardian, an administrator, or both, for a person who lacks capacity. Appointment is a last resort. The lawyer confirms every statement about the person.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may check the application against the tribunal's current form and index reports already on the file; the lawyer checks every statement about the person, and health information stays in approved tools.

AI may

  • Check every part of the draft application is complete and list missing information or attachments
  • Index medical or other reports already on the file, with author, date and the decisions each report addresses
  • Build the list of people to be told, from names already on the file

AI must not

  • Must not describe the person's disability, capacity or views in words the lawyer and applicant have not confirmed
  • Must not draft a health practitioner report, medical report, statutory declaration or affidavit
  • Must not assess whether an order is needed or who should be appointed
  • Must not process health information in a tool that is not approved for sensitive information
  • Must not sign or lodge the application

The lawyer checks

  • The application is on the current form, for the decisions that are actually needed
  • Less restrictive options have been considered
  • Supporting reports are current and address those decisions
  • The person, and others who must be told, have been identified
  • The current practice direction on generative AI, if any, has been checked

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
