Where this comes from
The official form is published by qcat.qld.gov.au; this page is a completion guide. Last checked on 2026-10-18.
When to use it
Use when asking QCAT under the Guardianship and Administration Act 2000 (Qld) to appoint a guardian and/or administrator for an adult with impaired decision-making capacity, to approve containment, seclusion or other restrictive practices, or to review an appointment.
Used for these tasks
- Prepare a guardianship or administration tribunal application pack
- Prepare a tribunal guardianship application checklist (NCAT/VCAT/QCAT/SAT)
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may check the application against the tribunal's form and organise the medical and other reports on file; the lawyer checks every statement about the person in each application, and the person's health information stays in approved tools only.
AI may
- Check every part of the draft application is complete and list missing information or attachments
- Index the medical and capacity reports to attach, with author, date and the decisions each report addresses
- Build the list of parties and people who must be sent a copy, from the file
AI must not
- Must not describe the person's disability, capacity or views in words the lawyer and applicant have not confirmed
- Must not assess the person's decision-making capacity or whether an order is needed
- Must not process the person's health information in a tool that is not approved for sensitive information
- Must not sign or lodge the application
The lawyer checks
- A specific need for the appointment, and why existing decision-making arrangements are inadequate
- The Adult has been told and has had a chance to express their views (QCAT will send them a copy)
- Copies of any enduring power of attorney or advance health directive attached, with the attorney's contact details
- The proposed guardian or administrator is willing and able to act and to attend the hearing
- Health professional report on the Adult's capacity obtained
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
