Where this comes from

The official form is published by act.gov.au; this page is a completion guide. Last checked on 2026-10-22.

When to use it

Use when a competent adult in the ACT is writing a Statement of Choices about values, treatment preferences and what would be unacceptable. Do not use it as the approved enduring power of attorney or as health direction AF2017-46. The tool does not write the wishes.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may check the pack against the current form and list missing documents. The lawyer writes the instrument, the powers, the wishes and any witnessing or capacity words, and checks every signing.

AI may

  • Check the pack against the current official form and list missing parts named on the page
  • Flag when an enduring power, a health direction, a statement of choices or an advance personal plan is being used for the wrong purpose
  • List the witness categories and the registration path stated on the page that was opened

AI must not

  • Must not draft the instrument, the powers, the person's wishes, a treatment refusal, or witnessing or capacity words
  • Must not copy an example statement from a public page into the person's document
  • Must not sign or lodge the instrument

The lawyer checks

  • The current Statement of Choices file is downloaded from the health page. No approved-form number was stated on that page
  • The wishes are the person's own, not a reused example
  • The enduring power and the health direction are separate documents if they are also being made
  • The court's or tribunal's current index is checked before assuming a generative-AI practice direction applies. None was stated on the page opened for this guide.

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
