Where this comes from
The official form is published by legislation.act.gov.au; this page is a completion guide. Last checked on 2026-10-22.
When to use it
Use when an adult in the ACT is making the approved enduring power of attorney, AF2017-45. The lawyer checks which decisions the current form allows. Do not use the health direction or the Statement of Choices for this appointment. The tool does not choose the attorney or the powers.
Used for these tasks
- Draft an enduring power of attorney (financial) from the instructions
- Draft an enduring personal/health decision-making appointment
- Build the execution and witnessing plan for an enduring instrument before signing
- Review existing enduring powers, guardianship orders and advance care directives
- Build a decision-making map: who holds which power, from when, and over what
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may check the pack against the current form and list missing documents. The lawyer writes the instrument, the powers, the wishes and any witnessing or capacity words, and checks every signing.
AI may
- Check the pack against the current official form and list missing parts named on the page
- Flag when an enduring power, a health direction, a statement of choices or an advance personal plan is being used for the wrong purpose
- List the witness categories and the registration path stated on the page that was opened
AI must not
- Must not draft the instrument, the powers, the person's wishes, a treatment refusal, or witnessing or capacity words
- Must not copy an example statement from a public page into the person's document
- Must not sign or lodge the instrument
The lawyer checks
- The current approved form is AF2017-45, or a later version the register shows in force
- Guidelines on the Public Trustee and Guardian website, which the register points to, are read. That site was not opened for this guide
- Witnessing, capacity and the powers are in the words the person and the lawyer have settled
- The court's or tribunal's current index is checked before assuming a generative-AI practice direction applies. None was stated on the page opened for this guide.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
