How AI is used
In a firm-controlled tool, screen a transport accident against TAC eligibility and the no-fault supports named on the TAC common-law page, including attendant care. Do not decide eligibility and do not apply another scheme's lifetime-participant test.
What the lawyer must review
  • Screen against TAC eligibility and the named no-fault supports. Do not decide eligibility.
  • There is no separate lifetime-participant gateway on the Victorian pages opened.
  • Keep the clinical records in a firm-controlled tool. ASCR r 9 and APP 11 apply.

The work product

Forum. Victoria: TAC no-fault treatment, rehabilitation and attendant care after a transport accident

Produce. A screen listing the eligibility inputs and the named no-fault supports, with no eligibility decision.

Have ready. How the accident happened; Whether a transport accident is alleged; The treatment, rehabilitation and attendant care sought; Any common-law step already taken.

Example of the limit. Illustrative example: The instructions describe a severe injury in a transport accident and ask about attendant care. The tool lists the TAC eligibility inputs and the no-fault supports named on the TAC page, and it records that no separate lifetime-participant test was opened. The lawyer decides eligibility.

Stop and hand it back when

  • A lifetime-participant test from another scheme is about to be applied.
  • The screen would be sent as a decision that the person is eligible.
  • Clinical records would be placed in a public tool.

Checklist

  1. The eligibility policy: the TAC pays compensation if the accident meets the section 3 transport-accident definition and the person is eligible under the Act (the page cites section 35). Fault is not considered. Injury means physical or mental injury as a direct result of the transport accident. Sections 3 and 35 were not opened.
  2. The common-law page glossary lists no-fault benefits that may include medical, hospital, nursing, attendant care, rehabilitation and disability services, among other items. Record which of those the instructions ask about. Do not decide that any is payable.
  3. No Victorian catastrophic-injury percentage, and no separate lifetime-participant gateway, was on the pages opened. Do not create one.
  4. A common-law damages path is separate and uses the serious-injury gateway on the TAC page. Do not treat lifetime supports as that gateway.

The NIISQ eligibility page was opened for contrast. It is a Queensland motor-accident lifetime-care scheme from 1 July 2016, with its own injury criteria. Do not copy those criteria into a Victorian screen.
