Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may record the certificate type, the principal-photography date, and which of the three stated rates the project appears to fit. It must not calculate qualifying expenditure or say a certificate will issue.
AI may
- Record whether the application is for a provisional certificate, a reassessment, or a final certificate
- Record the principal-photography start date and whether it is on or after 1 July 2021
- Mark the 40 per cent row or the 30 per cent row only as the landing page describes them, and leave the box blank if the project does not plainly fit
AI must not
- Must not state a qualifying Australian production expenditure test, a minimum spend, or a gallery of eligible formats
- Must not apply the 40 per cent or 30 per cent figure to a project that began principal photography before 1 July 2021
- Must not treat the Treasury Laws Amendment (2021 Measures No. 5) Bill, as the page names it, as a section that has been read
- Must not lodge the application or sign a statutory declaration in the portal
The lawyer checks
- The current guidelines PDF and the Producer Offset Rules 2018 have been read before any expenditure figure is used
- The 40 per cent row is used only for a feature film produced for commercial exhibition to the public in cinemas
- The 65-commercial-hour cap is not treated as still applying to drama, and is not assumed to have been removed for any other kind of program
- A pre-1 July 2021 project is sent to the Producer Offset and Co-production Unit rather than through this checklist
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
