When to use it
Use when a Centrelink decision may be reviewed, or when an application to the Tribunal would be late. It records the dates. It does not choose the ground of review.
Used for these tasks
- Build the Centrelink or DVA decision, debt and review-deadline register
- Prepare an extension of time application for a late Centrelink review
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may calculate the dates in this register from the decision letter; the practitioner checks which time limit applies before an application is lodged.
AI may
- Enter the date the person was told of the decision and count 13 weeks
- List the Tribunal limits from the Tribunal page beside the limits on the Services Australia page, without merging them
- Note that an extension must be in writing and that the review starts only if the extension is granted
AI must not
- Must not invent the Child Care Subsidy, Family Tax Benefit, Parental Leave Pay or Tertiary Access Payment formal-review limits; those pages were not opened
- Must not lodge an application or write the reasons
- Must not say there is no time limit merely because one of the two pages is silent
The lawyer checks
- The decision letter is read for the limit it states
- An Authorised Review Officer or subject-matter expert has reviewed the decision before a Tribunal application, as the Tribunal page requires
- Family assistance, Paid Parental Leave and student assistance are given the specific limits, not the general 13 weeks
- A late application includes a written extension request, and the fee position is checked on the day of lodgement
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
