When to use it
Use when the records index shows a gap and a personal information request to DVA is being considered for a living claimant, a representative, or a deceased person's file.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool may record the path and the 30-day date, and the lawyer confirms consent and whether a request, rather than an FOI application, is the right step.
AI may
- Record whether the request is for the claimant, a consented representative, or a deceased person's records.
- Name the form the page specifies for that situation, without filling the form in.
- Enter 30 days from lodgment as the department's stated aim, and record that no charge applies on the page.
- Record that the page says there is no right of review of a personal information request.
AI must not
- Do not complete the webform, form D9394, or form D8601. Those forms were not opened.
- Do not say the department must answer in 30 days. The page says it aims to.
- Do not treat administrative release, the DRCA, the MRCA and APP 12 as different outcomes. The page says the method does not change the outcome.
- Do not describe the FOI review. The page says an FOI request may be made if the information supplied is inadequate, and the FOI page was not opened.
The lawyer checks
- Confirm informed consent, or a lawful basis for release without consent, before a representative asks.
- Re-read the page before the 30-day aim or the no-charge statement is repeated. The page was last updated on 1 October 2025 when read.
- Use D9394 only for an advocate or representative asking about a deceased person, and D8601 for a family member or another person acting with the client's authority, as the page divides those forms.
- If the scope is wide, expect the department to ask for clarification. The page says it will do that if the scope is unclear or unreasonably large.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
